Fair Work Australia and the legal system are paying close attention these days to the issue of sham contracting - hiring as independent contractors people who should properly be treated as employees with the appropriate benefits. A recent case in regional New South Wales resulted in heavy fines for both the company and its director, and Joydeep Hor of People and Culture Strategies says it provides a timely warning to business owners to classify people correctly, or face the expensive consequences.
