It can come as little surprise that with the massive accumulation of funds now being held in superannuation, a rapid rise in court cases has followed as beneficiaries and others fight over the proceeds.Superannuation expert Peter Bobbin, of Argyle Lawyers, outlines what's been happening in the courts, the differences between the larger super schemes andSMSFs in the management of the cases; and he warns that super can have a long negligence liability tail. So get it right and understand the watchouts, he says, to avoid being caught out.
