  Running Time: 10:00 Date: 01/06/2013 Proposed new legislation will put bullying into the arena of the Fair Work Commission - that will create new headaches for employers. Recent government proposals to bring bullying into the purview of the Fair Work Commission will mean greater trade union involvement, which is likely to show itself in an increase in complaints at times of industrial action, says Andrew Douglas of M+K Lawyers. Describing it as an "incredibly odd" decision, he says it breaks the structure of the Fair Work Commission's role and will mean employers will have to be even more aware of the risk of litigation over allegations of workplace bullying. The best defences: make sure you define what's acceptable and unacceptable behaviour in your workplace, empower managers and supervisors to deal with problems promptly and directly, document all relevant conversations and meetings, and be fair and reasonable in your dealings with staff.
