How responsible are you as an employer for things that happen outside the workplace, or out of business hours?

It's not easy to establish clear guidelines, based on case law, for how far employers can go in taking action against employees for conduct that happens outside the workplace or business hours. Joydeep Hor, of People + Culture Strategies, says different tribunals operating in different areas - workplace health and safety, workers' compensation or under the Fair Work Law - are coming to different conclusions on unfair dismissal. The proliferation of social media, and cases arising from its alleged misuse, are further complicating the issue.The question employers should ask themselves before taking action is: does the conduct have the capacity to impact working relationships within the workplace? Employers must also ensure that they have their policies and procedures clearly documented, and clearly understood by employees.
