Performance management can be a daunting business if you don't have the skills and training. But getting it right can help you avoid a host of legal pitfalls.

For many managers and supervisors, performance managing their staff is something they'll try to avoid at all costs. It takes them out of their comfort zone, potentially into conflict and a legal minefield. But, says lawyer Joydeep Hor, of People and Culture Strategies, that's usually because they haven't been given the training and skills that the law requires. He advocates a holistic and integrated approach, seeing performance management as part of an employment and staffing policy that's underpinned by the values of the business, and carried out consistently and fairly.
